Yes. Illinois legalized recreational cannabis in 2020 but employers retain the right to enforce a zero-tolerance drug-free workplace policy. You can decline to hire or take disciplinary action based on a positive THC result as long as your written policy clearly states it. One important nuance — Illinois law requires that employment decisions be based on actual policy violation, not just impairment alone. DOT-regulated employees are a different story entirely — federal zero-tolerance rules apply regardless of state law, with no exceptions.

Yes, and most employers don’t know this. Illinois allows employers to use a positive drug test result as an intoxication defense against a workers’ compensation claim. A positive test can also make an employee ineligible for unemployment compensation. To leverage either benefit, your program must be set up and documented correctly before an incident occurs — not after. This is one of the strongest financial reasons Chicago employers implement a formal drug testing program.

DOT testing applies to employees in federally regulated safety-sensitive positions — CDL drivers, transit workers, pipeline operators, and others under FMCSA, FTA, FAA, or PHMSA rules. The test type, collection process, lab certification, and MRO review are all federally mandated under 49 CFR Part 40. Non-DOT testing gives employers more flexibility in panel selection and program design, but best practice is to follow the same chain-of-custody standards. If you’re unsure whether your employees are DOT-covered, that’s the first thing to clarify before setting up a program.

Illinois doesn’t mandate drug testing for most private employers, but you should not test without a written policy in place. Without one, a positive result is difficult to act on and creates liability exposure. A written policy defines what you test for, when testing occurs, and what the consequences of a positive result are. It also protects you under Illinois workers’ comp and unemployment law. For standard lab-based urine tests, negative results typically come back within 24–48 hours. Non-negative results go through MRO review, which can add one to two business days. Instant tests provide a preliminary negative result on the spot — non-negatives require lab confirmation and MRO review before a final result is issued.
